Thread Title: "Member "ralphe" is posting false information on his auctions."
(no avatar) This seller has, on each of his auctions, this statement: "PLEASE NOTE NOTHING CAN BE SHIPPED TO CALIFORNIA IF YOU ARE IN THAT STATE PLEASE DO NOT BID". An uninformed member, reading this, might get the impression that he cannot ship a firearm to California. This is not true. The seller simply choses to not sell firearms to buyers in California. I have asked him to clarify his statement to something like: "Due to oppressive gun laws in California, I refuse to sell to residents of that state." He claims he does not see the difference between the two statements. It seems clear to me that his intention is to make it more difficult for California buyers to do business with ANY seller on AuctionArms. His attempt to harm the market that AuctionArms caters to should not be rewarded by supporting his business.

(no avatar) hi this is the culprit himself ...when i wrote that it was in a forum about the new california law ...i believe it is illegal for any state to pass laws that try to control persons from another state ..if i lived in california i would have to jump thru any hoops they set before me or move ...but living here in maine i feel that i am willing to put up with harsh winters and a bumper crop of blackflies ...i do not have to put up with foolish laws of that state ...so until they change that law I WILL NOT SELL GUNS TO CALIFORNIA ... and i understand the bind that gun owners in california have ...sorry that you live in such a horrible place RALPHE AKA RALPH E MCLEOD

(no avatar) i wonder if the law interfers with interstate commerce? and what next,maybe you will need a license from kal. to sell and ship guns to kal. and will have to collect and send kal. sales tax to. think of the money kal. could raise, you will need a ffl then a kal. state license and a county and city license,plue a state sales tax number just to do business in the fruit and nut state. and of course after the other nut case states see how kal. is raising all that money they will want to join in. eastbank.

Hartwell Gun Ralphe-Failure to stand up and voice their discontent with the liberal,rights grabbing,Nazi like thieves they elected to office in CA is the problem.But instead they complain here,their no resistance mentality is the cause for some to post No Guns To CA!!Hello CA!!The real culprits are in your court house and state assembly.You have to start the fight before you can expect help from the outside.

(no avatar) I live in California and just talked to the Calif. D O J on this subject. What I was told is that all pistols must be sent to a type 1 ffl. all modern long arms must be sent to a type 1 ffl. Any C&R long arms can be sent directly to the type 3 C&R ffl holder. Hope this helps Dan

(no avatar) D.B. Olson....If you just talked to them (CDOJ) then it it obvious that you are not an FFL holder and if you are you must have been out of town for the last 2 months. What you just learned.....we have been talking about here on Auction Arms for a while now and I just would like to ask you a question.

Have you or anyone you know started a law suit against the state for violating the interstate commerece laws........ protected by the constitution?

If not I would ask ....why not?!!

There are those of us out here ready, willing, and able to help fund the expenses of doing so but we need someone in your state to stand up and be heard. I really wish somebody would get this started soon as time without a voice is generally perceived as acceptance.

As for myself....I will no longer sell ANYTHING to California!

(no avatar) Eldorado1, The new law does not violate the "interstate commerce laws" any more than requiring an NICS check, to buy a handgun, violates the 2nd amendment. No seller on AuctionArms would ship a handgun to a buyer without first receiving a copy of an FFL to which to ship it. All California is requiring is that the seller log onto a website and confirm that the FFL is legitimate and not some gangbanger in L.A. who Xeroxed someone's license. Many sellers here are already doing this and charging their California buyer an extra $10 for the hassle. This seems fair. Any seller who acts like a petulant child and declares "I will no longer sell ANYTHING to California!" has joined the side of the gun grabbers.

The NICS is mandated by the federal government.You state government is mandating me,and others,to sign up in order to sell to CA.My FFL allows me to do this already.Every state has it's hell holes,handle it from within like states others do, not buy attempting to place the burden and restrictions on others,in other states.The CA folks have been allowing the gun grabbers to run free in that state,with impunity, for the past twenty years.Clean your own house and stop blaming others because your house is dirty.

You didn't say whether you are from California or not but you are sooooooo....wrong my friend in your assumption that it does not violate the provisions of interstate commerce. As Hartwell so politely pointed out to you that when a Federal Firearms License is granted to an individual it is the licensure to conduct transactions with other FFL holders throughout the United States.

As far as fradulent transactions are concerned, you apparently are not familar with the process of checking a license for validity so I won't belabor the point of explaining it to you. If you are from California I understand your dilema and sympathise with you and will gladly contribute financially for a defense fund for someone to get a lawsuit filed against the state for the Violation of the Interstate Commerce Laws that are protected by the Constitution of The United States, but I will not join the ranks that are misinformed and are adding their names to a list that could prove to be detramental at a later point should someone from California get off their high horse and get a lawsuit in process.

Time is a critical element in matters such as this and I urge you to quit trying to play a lawyer and go find one that will challenge this in court.

If we sit back and do nothing.....that is exactly what we will get.

(no avatar) as eldorado said, there is a way to check to see if a FFL is legal and the firearm must be sent to the address on the FFL. so their story about checking FFL,s doesn,t hold much water. i still think it,s more of a money making scheme, as guns are a hot button issue, they can say it,s for public safety and may get away with it. then they can interfer with just about any item entering the state to get sales tax. and sales taxes are collected and sent by the seller with out much effort by the state, it could be a wind fall for a money strapped state. eastbank.
