The Bureau of Alcohol, Tobacco, Firearms and Explosives (ATF) has asked NSSF to help communicate to the dealer community in the Gulf Coast region that may have been affected by Hurricane Katrina with an important message. In the near future, ATF will begin attempting to contact Federal firearms licensees (FFL) in the affected areas to determine to what extent businesses were impacted. In the interim, the following is provided to assist FFLs with reporting missing and stolen firearms, storing firearms and records at a location other than the licensed business premises, and notifying ATF that firearms records were damaged or destroyed. Please know that in the wake of this tragedy, ATF will work with those affected to restore business operations as quickly as possible.

PROCEDURES TO FOLLOW FOR MISSING AND STOLEN FIREARMS

Stolen:

  • · If firearms are taken in a crime, conduct an inventory when it is safe to return to the business premises.
  • · Contact local police.
  • · Contact local ATF Office (see below for contact information) with the results of the inventory.
  • · Prepare ATF F 3310.11, Federal Firearms Licensee Firearms Inventory Theft/Loss Report, which is available at: http://www.atf.gov/forms/pdfs/f331011.pdf
  • · Contact the Stolen Firearms Program Manager as soon as possible at (888) 930-9275.
  • · Record the incident number provided by the Stolen Firearms Program Manager in the disposition section (along with the police report number) of the Acquisition/Disposition Records for every firearm that is stolen.
  • · Notify ATF of any firearm recoveries.

Missing:

  • If firearms are missing from inventory and there is no evidence of a crime, conduct an inventory when it is safe to return to the business premises.
  • Contact local police. Make it clear to the authorities that there is no evidence of a crime and that the disposition of the firearms is unknown. Note: No local police report number is required to be placed in the disposition records since many departments will not issue a police report if no crime has occurred.
  • Contact local ATF Office with the results of the inventory.
  • Prepare ATF F 3310.11, Federal Firearms Licensee Firearms Inventory Theft/Loss Report, which is available at: http://www.atf.gov/forms/pdfs/f331011.pdf.
  • Contact the Stolen Firearms Program Manager as soon as possible at (888) 930-9275.
  • Record the incident number provided by the Stolen Firearms Program Manager in the disposition section of the Acquisition/Disposition Records for every firearm that is missing.
  • Notify ATF of any firearm recoveries.

PROCEDURES TO FOLLOW TO STORE FIREARMS RECORDS AND INVENTORY AT A LOCATION OTHER THAN THE LICENSED BUSINESS PREMISES

  • Contact local ATF office
  • Provide Business Name, Licensed Premises Address, FFL Number
  • Provide telephone contact number
  • Provide temporary address
  • The local Field Supervisor may verbally approve an emergency variance request. You can be authorized to immediately remove firearms inventory and records to an alternate location.
  • You are required to maintain all firearms records for 20 years from the date of the transaction.
  • In the event of a firearm trace, you should inform ATF’s National Tracing Center of your situation and that a possible delay in obtaining the requested information needed to complete the trace may occur.

PROCEDURES TO FOLLOW WHEN FIREARMS BUSINESS PREMISES IS DESTROYED OR PARTIALLY DAMAGED

  • If the business premises is destroyed, contact your local ATF office to notify it of a new business premises, or if you elect to discontinue business operations.
  • If the firearms inventory is damaged, conduct an inventory when it is safe to return to the business premises. You should record the disposition of the damaged firearms in the Acquisition and Disposition Book.
  • If the firearms records (ATF Forms 4473 - Firearms Transaction Record and ATF 3310.4 – Report of Multiple Sale or Other Disposition of Pistols and Revolvers) are damaged, conduct an assessment of the damage to the firearms records when it is safe to return to the business premises. You should report the extent of the damage to the firearms records to the local ATF office.
  • You should not destroy any records until written approval has been received from ATF. Please forward any requests to Bureau of ATF, ATTN: Firearms Programs Division, 650 Massachusetts Avenue NW, Suite 7400, Washington, DC 20226.

ATF CONTACT INFORMATION:

FFLs in the States of Louisiana and Mississippi should contact the Little Rock, Ark., Area Office at (501) 324-6457.

FFLs in the State of Alabama should contact the Birmingham, Ala., Area Office at (205) 583-5950.

As backup, FFLs should contact ATF’s Firearms Programs Division at (202) 927-7770.
