Thread Title: "What would you do?"
(no avatar) I purchased a rifle a couple of weeks ago from a seller with good "Feed Back". Received the rifle around 2:30pm Apr.29 and notified the seller. On May 1 I was cleaning the rifle when I noticed a bulge in the barrel. I finished cleaning the rifle.On May 1 I sent an email telling the seller that I would return the rifle May the 4th and why I was returning it. This morning May 2 I had some slack time,got the rifle packaged and shipped.I sent the seller an email telling them that the rifle was shipped and gave them a confirmation #. This afternoon May 2 I received an email telling me that I had gone over the 3 day inspection period but they would take the rifle back. That all shipping was at my expense. They said that it is in their add. No where can I find this statement in their add. But I do find 2 places where they say that the bore is good. If I had of returned the rifle because I just did not like it, I can see where I should pay shipping. But when the seller makes a mistake,why should the buyer have to pay shipping? Thanks

(no avatar) Until that you can get AA to change their T&C then you will have to abid by them

AA T&C now say that the BUYER will pay return shipping

(no avatar) Joe I went back and read the T&C and you are right and I already knew it. Also I did not wait for return instructions. I had a chance to package and ship and I did. Just ticks me off that it cost me $40.00 to look at a rifle with a bulge in the barrel. And it ticks me off that they said I was over the 3 day inspection period when I was not. And they stated in 2 places that " the bore is good". If they had of stated that the barrel has a bulge I would not have bid. Thanks

I think this will all work out. I would keep AABob in the loop on this only for the risk of retaliatory negative feedback. He can't help you get the $40 back but I doubt the seller would trade the $40 for the negative she would wear for life. Don't do anything to give the seller just cause for giving you one back. That's against AA T&C's. No threats,profanity or such. Be professional as you always are even though when you are being treated unjustly. If you don't get the $40 back you will be warning others of this misrepesentation. I hope this helps.

(no avatar) Heed Grant's advice. I have had the same experience. For the most part Sellers can get by with unethical actions Buyers cannot. JohnT

Let me ask - when did your dealer received the rifle. The seller may be correct that it had been more than 3 dayss.

AA T&C read:

'Firearms Inspection Period: When a Seller sells a firearm (as defined by the BATF and for the purposes of this paragraph including antique firearms), the Seller is required to give the Buyer a minimum of three Business Days after the day of receipt by the Buyer's Federal Firearms Licensed Dealer ("FFL") or Curio and Relic Federal Firearms Licensee ("C&RFFL), or in the case of an antique firearm, by the Buyer, to inspect that firearm.'

T&C do state 'three Business Days after the day of receipt by the Buyer's Federal Firearms Licensed Dealer ("FFL")...'

I'm not taking sides but technically the seller may be right when he states you 'had gone over the 3 day inspection period'.

There are some buyers that believe the inspection period starts the day they pick up the item from the FFL - which is not the case.

We've had some individuals take as long as 6 weeks to get to their FFLs to take possession of an item.

Tuscahoma has an FFL. We have done some business together. Good advice otherwise.

I would disagree about Sellers getting away with anything in the way of unethical policies. A seller will lose bids. I've had buyers tell me they paid me $20 more for an auction just to know it would be a no worry transaction. A seller loses ALL of that with just a couple of bad sales out of a thousand.IMHO

I'll be away for the next 4 days. Flying to Horseshoe,Texas for a big Federal(ATK)sponsored shoot/conference. Can't hardly wait. Tuscahoma I hope this all works out. Take care, Grant Williams
