Thread Title: "Notice Revisions for Buyers under the 3 Business Day Inspection Period"

We've revised the site's Terms and Conditions by adding a paragraph to outline how a Buyer can preserve his rights to return a firearm under our 3 Business Day Inspection Period and to clarify that a firearm should not ever be returned without first contacting the Seller for instructions. The addition is as follows.

  • If a Buyer, after unsuccessful attempts to contact the Seller by telephone on at least 2 separate occasions, can not notify the Seller within the required time of his decision to return a firearm under the 3 Business Day Inspection period, the Buyer may preserve his right to return the firearm by sending an email notification to the Seller. The email notification should state 1) the auction number, 2) the Buyer’s desire for Seller’s instructions to return the firearm under the 3 Business Day Inspection period, 3) the dates and times he attempted to contact the Seller by telephone, 4) the number(s) called and, 5) the results of each call (no answer, left message, phone not in service, etc.). This email should be sent directly to the Seller with a copy to disputes@auctionarms.com. This email will provide adequate proof of Buyer’s timely notification of the Seller within the 3 Business day Inspection period. The Seller must either respond within 3 Business Days with return instructions by email (with a copy to disputes@auctionarms.com ) or by telephone. If the Seller fails to provide return instructions within 3 Business Days of the email notification, The Buyer should file a negative feedback on the Auction and notify disputes@auctionarms.com for further instruction and support. Under no circumstances should a Buyer return a firearm without receiving specific return instructions from the Seller.

THATS A SIX DAY TOTAL... WHAT IF SELLER GOES ON VACATION AND HAS AUCTIONS RUNNING AND ENDING WHEN HE OR SHE GETS BACK? HE HAS A NEGATIVE FEEDBACK KEEPING PEOPLE AWAY FROM HIS AUCTIONS NOT FAIR AT ALL.

WHAT IS ONE TO DO WHILE HE MIGHT BE HUNTING IN THE STICKS WITH NO CONTACT FROM THE OUTSIDE WORLD OR THERE WAS A DEATH IN HIS OR HER FAMILY OUT OF TOWN AND HE OR SHE HAD TO GO? YOUR GOING TO HANG THEM OUT TO DRY? I AND OTHERS I KNOW HAVE AUCTIONS RUNNING WHILE WE GO ON VACATION. YES I DO PUT IT IN MY AUCTION WRITE UP SOMETIMES BUT AT OTHER TIMES I DO NOT WANT TO LET THE WORLD I AM NOT AROUND FOR FEAR OF WHAT COULD HAPPEN..

YOU KNOW SOMEONE HAD A MAJOR HEART ATTACK AND HIS WIFE CALLED ME TO TAKE CARE OF HIS AUCTIONS. I HAD CALLED YOU AND IT WAS MAJOR WORK FOR ME CONTACTING ALL THE WINNERS OF HIS AUCTIONS AND CONTACTING THE PEOPLE THAT HAD SENT FUNDS THE WEEK BEFORE AND HAD TO GIVE THEM THE NEWS THAT NOBODY RAN AWAY WITH THEIR MONEY. YUP I WAS ON THE PHONE FOR HOURS AND GOT LOADS OF E MAILS. BUT I DID SAVE THIS GUYS BUTT.

YES THERE ARE SOME OF US FORTUNATE TO HAVE VERY CLOSE FRIENDS ON THIS SITE THAT WOULD HANDLE THE SITUATION. BUT LOTS DO NOT HAVE FRIENDS LIKE THAT.

I FOR ONE TELL PEOPLE GET THEIR PAPERWORK IN FAST WHEN I AM GOING AWAY ON A VACATION AND IF I DON'T HAVE THE PAPERWORK BY A CERTAIN DAY I TELL THEM THERE ITEMS WILL BE ON HOLD TILL I GET BACK. CAN'T LET THE MAIL HOLD ME HOSTAGE OR THE SLOW MAILING SOME PEOPLE DO..

SORRY YOU HAVE TO RE-THINK THIS ONE OUT. ALSO SORRY FOR THROWING THE MONKEY WRENCH IN.

THINK ITS TIME YOU MIGHT RE THINK THE NUMBER OF DAYS ESPECIALLY IF THE PERSON ON THE SITE HAS ANY AMOUNT OF GOOD FEEDBACK.

(no avatar) Willie Ta--- If a seller goes on vacation while he has auctions closing he is being irresposible and deserves a negative. If a seller has a family emergency of some kind which can happen to any of us maybe AA could notify the buyers informing them of the situation. No buyer would be upset once they are aware that a problem exists. A buyer could also have a similar situation. Tks

WHAT IS SO BAD IF A PERSON HAS AUCTIONS RUNNING WHILE ON A VACATION? I HAVE DONE IT. I RUN A 2 WEEK AUCTION AND AM BACK ON THE ELEVENTH DAY TO ANSWER QUESTIONS AND START MY NEXT SET OF AUCTIONS. I PUT IN AUCTION WRITE UP I WILL BE ON VACATION AND WILL ANSWER QUESTIONS AFTER A CERTAIN DAY. I AM TAKING CARE OF BUSINESS.

IN THE ON LINE BUSINESS THINGS TAKE TIME. I RUN A TWO WEEK AUCTION. THEN I GIVE WINNER TWO WEEKS TO GET FUNDS TO ME. I SHIP AND ITS CROSS COUNTRY GROUND UPS OR FEDEX TAKES 5 BUSINESS DAYS. THEN CUSTOMER HAS THE 3 BUSINESS DAY INSPECTION. THATS ALMOST 6 WEEKS TOTAL. DO YOU SHUT DOWN YOUR BUSINESS FOR 6 WEEKS AT A TIME???

AA-bob Guys, please note this is a change in a Buyer's rights to return an item when he can't make phone contact with a seller! Previously he had to make phone contact within three days after receiving a firearm in order to return it for a refund. This new procedure is how he is able to establish he tried to contact the seller during the specified time but could not through no fault of his own. As it was previously, a seller could merely not answer his phone for three days after a buyer received the firearm, then claim the buyer did not comply with the Terms and Conditions and refuse the return on that technicality. This also lengthens the time before a buyer can post negative feedback (before he could post a negative feedback if the seller was incommunicado on the return after 3 days) it also strengthens the requirement that a contact be made with the seller for return instructions prior to returning a firearm to a seller. The negative feedback can be dealt with post-return, if need be, and is designed as a minimum to get the non-communicating seller's attention in this scenario.

(no avatar) I have one problem with your 3 day inspection -new items [gun] if someone purchases a new gun it is by law a used one when they return it

(no avatar) david49...I dont think so because the buyer can not fire the gun or turn any screws or pins,and the seller still owns it for the 3 day inspection

I also know that if you give any one of the sellers a negetive then all of the sellers that are in the alliance will block that buyer
