(no avatar) Here in TX it's legal. I don't and won't and some potential buyers are expectant - I've had numerious inquiries regarding 'coming and picking it up in person', I've stood firm and sofar, its been ok. My stand is if I don't know you, you're going to get backgrounded before you get a gun that belongs to me.

Of course I'm speaking of a private sale within the buyer's and seller's home state, NOT selling offline on A-arms.

I'm curious how others deal with the issue when it comes up for them.

Elitist Technically a licensee can sell only at his licensed premises or at a gun show in his home state, if the gun is on his inventory. But if the gun is part of his "private collection" and hasn't ever been logged into his book, he has the same status as anyone else WRT private sales. Yes, it's legal to do this. If the gun is part of your inventory and you want to put it into your private collection, you have to log it out to yourself, but if it was there before the license was acquired it does't have to be logged in at all and can remain "off paper." BTW, the same is true for C&R holders: if you get a C&R license you are NOT required to list any C&R qualified firearms you hold at the time the license is issued. At one time the BATF tried to make C&R holders do exactly that, but they lost a court case on the matter in the early 1990s and don't have the authority to compel it. As a practical thing, though, very few -01 holders would be willing to sell a gun "off paper" except to someone they have known for years and trust; and maybe not even then. That's one of the effects of the BATF's intimidation policies: to scare people into doing MORE than the law demands.

(no avatar) DAVEOMATIC ; IT'S LEGAL IN ALABAMA , THE SAME AS BUYING AT A GUN SHOW OR TRADE DAY . I THINK IF I GET ASKED BY SOMEONE IN MY STATE TO COME AND PICK A GUN UP THAT WAS WON ON AUCTION I PROBABLY WOULD AGREE TO IT WITH SOME KIND OF PROPER IDETIFICATION . BUT IF I WAS UNEASY AFTER MEETING THEM I WOULD JUST RUN OVER TO MY F. F. L. HOLDER AND LET HIM DO THE TRANSFER. HOWEVER I SEE NOTHING WRONG WITH THE WAY YOU DO IT EITHER . NOW DAYS IT'S BETTER SAFE THAN SORRY .
