| (no avatar) | PA requires firearms licenses issued by our county sheriff, since I have shops in two counties I need two PA firearms licenses to sell handguns, one for each shop. Our laws are similar.I researched our records the last couple days, back to Feb 04.We received 61 firearms transfers from other ffl's around the country.16 from AA dealers,9 from GB,6 from GA, and the others were relatives shipping or just other source unknown transfers.In ALL of these instances an FFL WAS included.I think a few years back it happened to me once.In 28 years Jake it may have happened a couple of times. Seems I've never received an FFL from JSC,SOG,Acusport,etc on new firearms so I doubt the feds require it. My customers ship their own guns to ffl's for repair or sale. Jake this thread sounds like you have encountered a significant number of instances that this occured exclusively with AA sellers,how about a few details? Many sellers don't have FFl's so is it the dealer they have chosen to ship the firearm who is omitting them or storefront AA sellers omission? How many occurences in total? Where is your data source:own experience? a pool of FFl associates? a storefront in NY? Only AA sellers or all online sellers? Maybe its sellers like me who include an ffl when I sell on GA but purposely omit it when selling on AA!(just kidding jake) I'm certain Manny would want to know if his sellers WERE breaking some NY law,how about a suggestion to fix this problem, when proven? | (no avatar) | I am a FFL in Wisconsin. I have bought/sold 30 or so guns on Auction Arms. Ever gun I have bought on the site had a copy of the senders FFL and everything I have sold on the site had a copy of my FFL in the box with the gun. Most people seem to understand that this is the way it needs to happen. If a seller refused to include a copy of their FFL when they shipped a gun to me, I would let them keep the gun. New Youk dealers and citizens have enough BS gun laws imposed upon them without the rest of us creating unnecessary problems for them. Wait a minute. What kind of New Yorker are you anyway? Just tell them to put the God@#%# copy of the FFL in the God#%$@ box and shut the F&$@ up. jubjub |

| (no avatar) | Well several of you seem to have a gross misconception. If you read the GCA that there is no requirement for the seller to have an FFL. There is a requirement that when shipping a firearm that the RECEIVING PARTY must have an FFL. I have purchased firearms from other dealers in the State of New York and they do not send me a copy of their FFL, however I must provide a signed copy of my FFL in order for them to ship it to me. The state of New York cannot impose the requirment for a seller to have an FFL but they can require that Dealer have an FFL in order to traffic in Firearms as a business but they cannot require me to include a signed copy of my FFL when shipping to that state. The party I am shipping to is required by Federal law to have a valid FFL. Do you have an FFL or a C&R???? |

SO IS IT A STATE LAW OR IS IT A STATE RULE. A LAW CAN NOT BE CHANGED, A RULE CAN BE CHANGED. I UNDERSTAND A SELLER ON AA DOES NOT HAVE TO BE A FFL HOLDER (DEALER)TO SELL A GUN/GUNS. THE SELLER CAN NOT SHIP DIRECT TO THE BUYER. THE BUYER HAS TO PRODUCE AN UP TO DATE COPY OF FFL FROM A FFL DEALER, GUNSMITH, PAWN BROKER SIGNED IN INK AND (IT HAS BEEN SUGGESTED TO BE SIGNED IN RED OR BLUE INK.) ENCLOSED WITH THE BUYERS PAYMENT TO THE SELLER. I SUGGEST THE SELLER CALLS FFL HOLDER AND CONFERM THAT THE SHIPPMENT IS TO BE SHIPPED TO HIM/HER. THE SHIPPING AGENT MAY ASK TO SEE THE COPY OF THE FFL OF THE RECEIVER AND INSPECT THE GUN/GUNS. PUT THIS FFL IN SHIPMENT, MAKE SHIPPMENT ATTEN: TO MR. __________, PHONE NUMBER, AND ADDRESSED TO FFL DEALER. THE DEALER WILL CONTACT THE BUYER AND TRANSFER THE GUN/GUNS TO HIM/HER IN PERSON. IF YOU CAN NOT OWN A GUN/GUNS WELL FORGET IT. WHY WOULD I THE SELLER HAVE TO PRODUCE A FFL TO THE BUYER'S FFL TO RECEIVE THEIR PAYMENT AND FFL. I REALY WANT TO KNOW.
